What data is processed?

We collect various personal data, including:

• Identification data, such as your last name, first name, marital status, date of birth, nationality, postal address, landline phone number, mobile phone number, and email address;
• Professional data, such as your industry and profession;
• Financial information such as your IBAN and BIC/SWIFT codes, when necessary for the provision of services or for accounting purposes;
• Data relating to your habits and preferences regarding your behavior when using our websites;
• Information provided by candidates when applying for a job;
• Data provided when creating your user account, such as your email address;
• Information provided in the context of our communications (by email or other means);

Why do we process your personal data?

We process your personal data for various purposes. For each purpose, only data that is relevant to the pursuit of that purpose is processed. Your personal data may be processed for the following purposes:

• The performance of a contract: Constatimmo SRL must collect certain data from you in order to respond to your requests. If you choose not to share this data with Constatimmo SRL, this may make it impossible to perform the contract;

• Constatimmo SRL’s legitimate interest: Constatimmo SRL has a legitimate interest in interacting with you, responding to your requests, and above all improving its services, preventing abuse and fraud, exercising, defending, and preserving its rights, unless these interests are superseded by your interests or fundamental rights and freedoms requiring the protection of your personal data.

Who do we share your data with?

Our employees and subcontractors only have access to your data to the extent necessary to perform the services and achieve the objectives pursued (purposes set out above). Each of them is subject to a strict confidentiality obligation.

We may share your personal data with certain trusted third parties in accordance with the contractual provisions in force with them. These include:

How long do we keep your data?

We only keep your personal data for as long as necessary for the purposes for which it was collected.
Constatimmo SRL keeps personal data when necessary to assert its rights or defend itself against legal action, until the end of the relevant retention period or until the actions in question have been completed.
Once these objectives have been achieved, all personal data is deleted or anonymized.

How is your data secured?

Constatimmo SRL implements appropriate technical and organizational measures to protect your personal data against destruction, loss, alteration, modification, or any unauthorized processing. These protective measures are regularly adapted to technical developments and organizational changes.
In this regard, our partners, employees, consultants, workers, and subcontractors who have access to personal data are required to respect the confidentiality of this data.

What are your rights?

In accordance with regulations on the protection of personal data and within the limits of these regulations, you have the following rights regarding the processing of your personal data:
Right of access: You have the right to request confirmation that your data is being processed—or not—as well as access to the data we hold about you and to request details of how we process it.

• Right of rectification: You have the right to have your personal data corrected if it is incomplete or inaccurate.
• Right to erasure: You have the right to have your personal data deleted, except for data that Constatimmo SRL is legally obliged to retain.
• Right to restriction of processing: You have the right to obtain restriction of the processing of your personal data and, in the event of restriction, to restrict the processing to the simple storage of such data.
• Right to portability: You have the right to receive your personal data in a structured, commonly used, and machine-readable format, and you have the right to ask us to transfer this data to another data controller.
• Right to withdraw consent: When processing is based on your consent, you have the right to withdraw your consent at any time. Withdrawal of consent does not affect the lawfulness of processing already carried out prior to withdrawal. We may be required to continue processing your personal data to the extent required or permitted by law.
• Right to object:

All requests must include sufficient proof of identity. Constatimmo SRL undertakes to examine all requests or complaints and to respond to them in a timely manner and, in any event, within one month of receiving the request. If necessary, this period may be extended to two months, depending on the complexity and number of requests.

To the extent provided for by Belgian and European data protection laws, you have the right to lodge a complaint with the Data Protection Authority if the processing of your personal data violates applicable regulations.

Where are your data transferred?

Constatimmo SRL may transfer your data to a country outside the European Economic Area (EEA) through its subcontractors or sub-subcontractors. We only transfer your data to a third country if it offers an adequate level of protection (for example, when there is an adequacy decision or through the adoption of appropriate safeguards such as standard contractual clauses).

Changes to the Policy

We may occasionally modify our Privacy Policy to comply with regulatory, jurisprudential, editorial, or technical changes. In this case, we will change the date of the last update and mention the date on which the changes were made. Where applicable, we will inform you and/or request your consent. Liability

In the event that your data has been legitimately communicated to third parties, Constatimmo SRL is not responsible for the processing of your data by them and for any violation or illegal use in this case.
